Terms of Service


RackBurst is a trading name of ABPNI Computer Solutions Ltd ("The Company"), a firm specialising in I.T. infrastructure and support services that is part of The ABPNI Group. Our servers are located in England, in a physically secure data centre complex.

We take pride in our services and strive to maintain the highest level of service to our customers. It is important to understand that customers also have a duty to act in a responsible manner, so everyone using the service has an enjoyable experience.


There are some terms and conditions associated with the service. We ask our customers to agree to them before using our services:


  • No illegal content may be stored on any server owned or operated by The Company, or transmitted using any connection which the servers are using. This includes material that may infringe upon the Intellectual Property rights of others or material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

  • You agree to abide by all laws of the United Kingdom while using our services. Additionally, if you chose a plan where your VPS is hosted outside of the UK, you must also abide by the respective country's laws.

  • BitTorrent (including websites which link to torrents), TOR related services, XDCC, and free web hosting services are strictly prohibited due to the abusive nature of such services. Private IRC clients and private bouncers are allowed provided they do not attract or cause any network abuse. IRC servers are allowed but please contact us first.

  • Private Proxies/VPN are allowed for legal purposes. You must not host any anonymous/unauthenticated/open proxy or VPN services to third parties. If you wish to host such a service to a third party, individual users must be identified and an audit log must be kept of all access to the service sorted by user ID; this log must be disclosed to The Company or any relevant law enforcement authority if such information is requested under relevant laws of the United Kingdom or Germany, or by The Company's upstream service providers.

  • You must not host content related to any form of Gambling.

  • You agree not to perform any CPU "mining" of any peer-to-peer currencies including, but not limited to, BitCoin, Litecoin and Primecoin.

  • You agree not to perform any CPU "folding" for any distributed/grid computing projects including, but not limited to, [email protected], [email protected] and World Community Grid.

  • Unless otherwise stated, all prices quoted are excluding UK VAT at 20%.

  • Network Bandwidth, Disk IO throughput and CPU time is currently monitored on a "fair usage" basis. Higher VPS packages are allocated a greater "share" than their lower counterparts. It is our policy that if a customer's use of our service negatively impacts The Company or the use of the service by other customers, then we will employ measures to counteract such negative impacts. This may include rate limitation and in extreme cases, account suspension/termination. We reserve the right to employ any measures without notice to you. Account suspension and termination are last resort measures and we will always endeavour to resolve the situation in an amicable way, if possible.

  • You agree to be solely responsible for the use of your VPS by you or external users, as well as any content stored. You agree to keep a record of all users who have administrative access to the VPS.

  • You agree to indemnify The Company, financially or otherwise against "Take down notices" by third parties, illegial materials or actions assoiated with the use of our services by you or any external users.

  • The Company takes intellectual property and libel laws very seriously, and if any "take down" notices are received by third parties, The Company will be forced to comply. You agree to not take any action against The Company if any of your content is removed due to such "Take Down Notices".

  • These terms and conditions may change over time, and you agree to accept new and revisied editions of these terms in order to continue the use of the services. The new/revised terms and conditions will supersede these terms, and you may only continue to use our services if you agree to the new/revised terms.

  • With "Unmanaged" plans, The Company does not provide any software services related to the services provided to you. "Managed plans" are available at an additional cost.

  • You agree to not cause any harm to The Company, other customers of our services or any other servers/users on the internet while using our services.

  • You agree that your data will be used solely and strictly for the purposes of providing the services to you, for any maintenance purposes related to the services provided to you, as well as to counter any network abuse cases as required by law. The Company takes Data Protection laws and your privacy very seriously and will not use or access your data for any purpose not specified in these terms.

  • You acknowledge that from time to time, The Company may outsource certain maintenance tasks to 3rd party contractors, who will be verified by the The Company to take Data Protections laws and your privacy very seriously.

  • You agree that The Company does not assume the responsibility to check that your data is compliant with relevant laws; this is entirely your responsibility.

  • You may not use our services to "Port Scan" other servers hosted on the internet, without first obtaining the respective owner's permission.

  • You may not take part in, or willfully attract any form of Denial of Service (DoS) attack against The Company's or any third party's infrastructure while using our services.

  • You agree that these services are provided on a non-SLA basis. While The Company strives to ensure as great an uptime as possible, problems do occur. You agree not to take any action against The Company due to any downtime of the services.

  • Unless a separate Backup Package has been taken up by you, you agree to be solely responsible for any backups/data replication of your data. As the services are provided to you on an unmanaged basis, you are entirely responsible for any data stored on your VPS. You agree not to take any action against The Company in the unlikely event of any data loss.

  • You must not use our services to access or attempt to access any system which you have not been given permission to.

  • You must not send unsolicited or bulk email, also known as SPAM while using our services. You must also not host services on your VPS which are advertised via SPAM.

  • All mailing list services must be opt-in and must use confirmed/verified email addresses. All confirmation/acceptance emails must be retained for the life of the respective mailing list.

  • You must not distribute worms/trojans/viruses while using our services.

  • The Company reserves the right to delete, without prior notice, any files hosted on your account if these files are found to be in violation of these terms.

  • The Company reserves the right to cancel your service, as well as delete your VPS, without prior notice, if your use of our services is found to be in violation of these terms.

  • We reserve the right to ask you questions regarding your use of the service. You agree to answer these questions in a full and truthful manner. By not replying to these questions, or by replying in a false manner, we reserve the right to terminate your service.

  • We may, at our discretion, choose to verify your address by posting you a card which you will have to complete and retun to us. By failing to return the verification card, your VPS service may be terminated/suspended.

  • If your account becomes the target of any form of attack, The Company reserves the right to terminate/suspend your account without prior notice.

  • Our services must not be used for any activities involving recreational drug use, regardless of the legal status of the respective drug. This does not include legal alcoholic or tobacco products.

  • You agree that if you wish to take advantage of our 10-day money-back policy, this must be requested explicitly via a Support Ticket. Cancelation requests, even those requested within 10-days, will not automatically trigger a refund. You agree that by opening any disputes with any payment provider will revolk your right to a refund under the 10-day money back policy, due to the time taken by us to resolve the dispute.

  • You acknowledge that our 10-day money-back policy may only be used once per account holder.

  • You acknowledge that any violation of these terms of service, or any experienced DoS attacks will result in non-eligibility of the 10-day money-back policy.

  • You agree to let us share all information related to your account in the case of a dispute opened with a payment processor, in order to give us a fair hearing.

  • You agree to indemnify The Company, financially or otherwise, against any loss incurred due to violation of these terms by you or your users.

  • Your account may be suspended/terminated without notice if The Company or any of The Company's upstream service providers disapprove of any material stored or hosted on your VPS.

  • You agree to be solely responsible for any of your external users/customers use of the services provided to you by The Company. It is important to make sure that their use of your VPS does not violate these terms.

  • If you set up a recurring PayPal subscription, you acknowledge that this is an action that is solely your responsibility and that you are asking PayPal to automatically send us money on a regular basis. RackBurst is unable to charge customer accounts. We are only able to receive money from customers.

  • You agree that it is your repsonsibility to cancel any PayPal subscriptions you have set up if you no longer wish to send us money automatically (due to cancellation, or otherwise).

  • You agree that any money sent to us in error via a PayPal subscription is non-refundable and will be added to your credit balance for use against any future RackBurst invoices.

  • You acknowledge that all credits added to your account will expire after 12 months if they remain unused.

  • You agree that it is your responsibility to make sure that emails from Rackburst are received by your email account. You agree to check that upon signing up that your "Account Welcome" email is received. Furthermore, you agree to regularly check your Junk/Spam folders for any emails from Rackburst, and take all resonable steps to whilelist these emails. If you are not receving emails from Rackburst, you agree to notify us immediately.
